1. Agreement to Terms

By accessing or using the website at luckylandlease.com (the "Site"), operated by Lucky Land and Lease, LLC("we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Site or our services.

2. Services

Lucky Land and Lease provides property management services in Minnesota, including:

Short-term rental stays — nightly vacation rental bookings through the Site.
Long-term rental applications — online applications for available rental properties.
Payment processing — online rent and invoice payments.
Investment information — general information about partnership opportunities.

3. Eligibility

You must be at least 18 years of age to use our services, make a booking, or submit a rental application. By using the Site, you represent that you meet this requirement.

4. Short-Term Rental Bookings

Reservations & payment

All bookings are subject to availability. When you submit a booking request and complete payment through our payment processor (Stripe), you are entering into a binding reservation agreement. The total price displayed at checkout — including nightly rate, applicable fees, and any pet surcharges — is the amount you authorize us to charge.

Cancellation policy

Cancellations made more than 7 days before the check-in date are eligible for a full refund. Cancellations made within 7 days of check-in are non-refundable. We reserve the right to cancel a booking at any time due to property damage, maintenance emergencies, or safety concerns, in which case a full refund will be issued.

House rules

Each property has specific house rules provided at booking and in your confirmation email. Violation of house rules may result in immediate termination of your stay without refund. You are responsible for any damage caused to the property during your stay beyond normal wear and tear.

Check-in & check-out

Check-in time is after 3:00 PM and check-out time is before 11:00 AM unless otherwise stated in your booking confirmation. Late check-outs not approved in advance may result in additional charges.

Maximum occupancy

The number of guests may not exceed the maximum listed for each property. Exceeding posted occupancy limits is grounds for immediate termination of the reservation without refund.

5. Long-Term Rental Applications

Rental applications submitted through the Site are subject to review and approval at our sole discretion. Submitting an application does not guarantee tenancy. All applications are processed in accordance with applicable Minnesota fair housing laws.

Information provided in rental applications must be accurate and truthful. Providing false or misleading information is grounds for denial or, if discovered after approval, termination of the lease agreement.

6. Payments & Invoices

Payments are processed securely through Stripe. We do not store your full credit card information on our servers. By submitting a payment, you authorize the charge to your selected payment method.

Rent payments are due on the date specified in your lease or invoice. Late payments may incur fees as outlined in your lease agreement.

7. Promotional Codes

Promotional codes are subject to the terms stated at the time of issuance, including expiration dates, usage limits, and eligible properties. Promo codes have no cash value, cannot be combined with other offers, and may be revoked or modified at our discretion. One promo code may be applied per booking.

8. User Conduct

You agree not to:

Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
Attempt to gain unauthorized access to any part of the Site, its servers, or any connected systems.
Interfere with or disrupt the Site or its infrastructure.
Submit false, misleading, or fraudulent information through any form on the Site.
Scrape, crawl, or use automated tools to extract data from the Site without prior written consent.

9. Intellectual Property

All content on the Site — including text, images, logos, graphics, design, and software — is the property of Lucky Land and Lease, LLC or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

10. User-Submitted Content

By submitting a review, comment, or other content through the Site, you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, and reproduce that content in connection with our services and marketing. You represent that any content you submit is truthful, does not infringe on any third-party rights, and does not contain unlawful material.

11. SMS & Communication Consent

By selecting "Text message" as your communication preference during booking, you consent to receive transactional SMS messages from Lucky Land and Lease related to your reservation, including booking confirmations, check-in instructions, and checkout reminders. If you opt in to marketing communications, you may also receive occasional messages about deals, new properties, and travel tips.

Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP to any message. For help, reply HELP or contact us at holly@luckylandlease.com.

12. Third-Party Services

The Site integrates with third-party services including Stripe for payment processing and Run The Rent for property management. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party providers.

13. Limitation of Liability

To the fullest extent permitted by law, Lucky Land and Lease, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or services. Our total liability for any claim arising from your use of the Site or services is limited to the amount you paid to us in the 12 months preceding the claim.

14. Disclaimer of Warranties

The Site and services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components. Property photos and descriptions are for illustrative purposes; minor variations may exist.

15. Indemnification

You agree to indemnify and hold harmless Lucky Land and Lease, LLC, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Minnesota.

17. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. Material changes will be highlighted on the Site for a reasonable period.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
